Texting Driver Causes Accident

The widow of a 62 year-old former marathon runner has filed a lawsuit against a driver who hit and killed the runner after the driver failed to stop at a stop sign. The lawsuit alleges that the driver was looking at his phone and texting at the time of the incident. The accident happened in Florida, and the Florida legislature is currently considering enacting a law that would ban texting while driving.

Since it is unusual that someone will witness a driver texting before an accident, phone records are the best form of proof. Once a lawsuit is filed, phone records are typically subpoenaed so that it can be determined if there was a voice and/or text conversation going on at or near the time of the accident.

That is exactly what the Plaintiff in this case has done. While the level of proof has yet to be disclosed, the attorney has said he is confident he can prove the allegations of texting while driving. Recall of Harmony High Chair

The US Consumer Products Safety Commission (CPSC) announced last week that the Harmony High Chair, produced by Graco’s Children Products Inc., is unsafe for use. More than 1.2 million consumers use the high chair. The announcement came after over 20 injuries were reported.

The chair is defective because screws holding the chairs together tend to loosen and fall out. Also,  the plastic bracket on the rear legs can easily crack and cause the chair to collapse. This product was sold at several different retailers between 2003 and 2010.

All parties involved in sending a defective product into the consumer market might be held responsible if the product causes injuries. This can include the designer, manufacture, supplier, or retailer.

St. Charles Accident Injures Three

Around noon on February 6, 2010 three individuals were injured in St. Charles County as a result of a car accident. The accident occurred on Highway 94 at South Breeze Lane. Jason Gamarin was driving a 2002 Chevrolet S10. According to the Missouri State Highway Patrol Gamerin failed to yield to an approaching 2010 BMW causing the front of the BMW to collide with the S10. Jacob Hamon, 27, was the driver of the BMW. Hamon was transported to St. John’s Mercy in Creve Coeur for medical treatment. Jennifer Hawkins, 25, and Dylan Hawkins, 6, were passengers in Hamon’s car and were also transported to St. John’s Mercy for medical treatment.
